Most surviving families don't know this relief exists. Federal law and New York State allow tax liabilities to be forgiven or refunded for qualified decedents whose death is attributed to a 9/11-related illness or injury.

Federal Relief

  • No cap on amount recoverable from the IRS
  • Surviving spouse OR personal representative may file
  • Minimum $10,000 guaranteed for qualified decedents
  • Past tax returns can be amended to recoup liability

New York State

  • Up to $30,000 forgiveness for surviving spouse
  • Up to $15,000 for children, parents, or siblings
  • Relief comes from decedent's funds, not state funds
  • Excess forgiveness refunded to the estate
